1. Facts and ruling The Régie départementale des passages d'eau de la Vendée (RDPEV) is the provider of a public service : it operates year-round in any weather daily ferry services for passengers, cargo and vehicles between the mainland and l'île d'Yeu. For this purpose, RDPEV uses three vessels : two ferry boats that it owns and a speed-boat («l'Amporelle») rented from regional authorities. In the summer season (April to September), private companies, including Vedettes inter-îles vendéennes (VIIV), operate competing ferry services for passengers. In 2001, VIIV complained before the French Competition Council that RDPEV had abused its dominant position on the market open to competition (i.e., passenger ferry services in the summer season) by, inter alia, charging prices below cost.
