The Bulgarian Competition Authority clears State aid in the form of compensation for public transportation services under national State aid rules (Elena Avtotransport)

By this Decision of 2 November 2006 the Bulgarian Commission for Protection of Competition (“the Commission”) cleared a State aid in the form of compensation for public transportation services, provided on the territory of Municipality of Elena, North-Eastern Bulgaria, by the transport operator “Elena Avtotransport” EOOD (“Elena Avtotransport”) on the basis of the Bulgarian State Aid Act [1]. One should note that, after the accession of Bulgaria, domestic state aid legislation remains in place. The rationale behind is that certain aid measures of marginal scale may not affect trade between Member States but may still jeopardize trade at regional or municipality level. The decision is noteworthy for the way the Commission applied the Altmark criteria and the domestic equivalent of Art.
