SGEI and competition law : An overview of EU and national case law

It is a great honour as well as a great pleasure to introduce this new special issue of e-Competitions Bulletin related to services of general economic interest (hereinafter “SGEI”) and competition law with an overview of EU and national case law over the last two decades. The fact is that the evolution of the debate on “SGEI & Competition law” has been tremendous since the 1990´, regarding both the EU primary law and the case-law of the EU Court of Justice. It may be useful to recall that the only reference to SGEI within the treaties was originally made in article 90, paragraph 2, of the ECC Treaty (then after article 86§2 of the EC Treaty, and now article 106§2 of the TFEU).
