The EU Commission prohibits a merger due to a lack of verifiable arguments on efficiencies (UPS / TNT Express)

On 7 May 2014, the European Commission published a summary version of its 30 January 2013 decision prohibiting the acquisition of package delivery service TNT Express by rival United Parcel Service (UPS) (see VBB on Competition Law, Volume 2013, No. 1). The Commission had prohibited the deal despite arguments that it would result in significant efficiencies.
