The Chinese MOFCOM conditionally approves an acquisition in the biotechnology sector (Thermo Fisher / Life Technologies)

On Tuesday 14th January 2014 MOFCOM conditionally cleared the acquisition of Life Technologies Corporation (“Life Technologies”) by Thermo Fisher Scientific Inc. (“Thermo Fisher”). The review process took 6 months from initial notification, which is relatively quick for an intervention decision by recent standards. The decision is important for the increased use of technical economic analysis in MOFCOMs decision. In part on the basis of this analysis, MOFCOM accepted commitments from the parties in addition to those required by the EU and US agencies, with whom MOFCOM co-operated in their investigation.
