The Polish Competition Authority conditionally clears a merger between multiplex cinema operators (Multikino / Cinema 3D)

THE POLISH PRESIDENT OF THE OFFICE OF COMPETITION AND CONSUMER PROTECTION CONDITIONALLY CLEARED A MERGER BETWEEN MULTIPLEX CINEMA OPERATORS* Background On 11 July 2018, the President of the Office of Competition and Consumer Protection (the “OCCP”) initiated merger clearance proceedings concerning the acquisition of Cinema 3D S.A. (”3D”) by Multikino S.A. (“Multikino”). Multikino is a cinema operator, which pre-merger ran 32 multiplexes throughout Poland and has operations, among others, in cinema screen advertising. 3D operated 12 cinemas across the country. On 17 May 2019, following in-depth phase II proceedings and a market inquiry, the OCCP cleared the transaction under the condition of selling one multiplex cinema in Gdańsk.
