The EU Court of Justice annuls the Commission’s decision regarding the liability of a parent for the infringement of competition law by its subsidiary and by a partially owned joint venture (RWE)

I. The Parties RWE AG is part of the RWE group with its main activities in the energy supply sector (gas exploration, electricity production, trading, and retail and grid activities). Regarding the activities in the paraffin waxes, RWE group is not currently active on this market due to the fact that this business was completely transferred to the Shell group in 2002. RWE Dea AG is part of the RWE group and is active in the sector of extraction of mineral oil and gas, production and distribution of mineral oil products and production and distribution of chemical products. II. The Facts By the Commission’s decision C(2008) 5476 regarding the infringement of Article 101 TFEU, the Commission found that RWE AG and RWE Dea AG have participated in a cartel on the paraffin wax and slack
