The Indian Competition Authority grants an interim order against online travel agencies alleged to have engaged in anti-competitive practices (MMT-Go / Treebo / FabHotels)

1. Introduction On 9th March 2021, India’s fair trade regulator, the Competition Commission of India (‘CCI’) granted Interim Relief [1] to the parties seeking it, Treebo and FabHotels. They had been delisted from the platform of India’s most popular Online Travel Agency (‘OTA’), MakeMyTrip (‘MMT-Go’). The CCI directed MMT-Go to relist them on it’s platform. This is a one of a kind remedy especially because not only has the CCI given too few Interim Orders till now but relisted a player in a platform for the first time. There have been only seven other instances where CCI has provided Interim Relief to the parties. This is the first interim measure in a digital market.
