The Spanish Telecommunications Authority closes proceedings for interim relief considering that Teléfonica’s commercial strategy for the launch of its pay-TV services is not a tying practice within the meaning of Art. 82 EC (Servicio Imagenio)

Telefónica de España, S.A.U. (hereinafter, “TESAU”) is a 100% owned subsidiary of Grupo Telefónica, the Spanish incumbent in the telecommunications sector. Under the commercial name “Línea Imagenio”, TESAU provides broadband Internet access and pay-TV services, including video-on-demand as well as interactive services, to end-users. On 29 December 2004 it notified to the Comisión del Mercado de las Telecomunicaciones (hereinafter, “CMT” or “NRA”), the National Regulatory Authority, its intention to launch a new promotion for the marketing of Línea Imagenio.
