On 14 September 2020, the Supreme Administrative Court (SAC) granted a cassation appeal lodged by the Czech Office for Protection of Competition (Office) against the previous judgment of the Regional Court in Brno of 5 June 2019 (Ref.No. 29 Af 96/2016) relating to the proceedings conducted by the Office for a gun jumping infringement contrary to Article 18(1) of the Czech Competition Act. The SAC held that the Regional Court in Brno erred when it mitigated the fine imposed for the respective infringement by the Office as it considered the imposed fine significant but not excessive.
