On April 29th, 2005, Logimail filed a complaint against Unipost. Logimail is a postal operator that performs pickup services, sorting and even distribution. To complete the distribution, however, it outsources the service to other postal operators. Unipost is one of the main postal-services providers in Spain. It carries out its activity either directly or through franchisees, one of them being GIC. The practice denounced by Logimail was the constant and unjustified refuse to receive and place a number of postal deliveries -a practice that restrict competition and therefore forbidden by the Spanish Competition Act (‘the Act') . The Servicio Nacional de la Competencia (‘the Service') supported the Logimail complaint and decided to investigate. The Service ended the investigation
