The French NCA's power to make an ex-officio reference stems from the provisions of Article L. 462-4 of the French Commercial Code, which provides: “The Competition Authority may, on its own initiative, make a reference for an Opinion on any issue related to competition. Such Opinion shall be published. It may also recommend the Minister of Economics or the minister in charge of the sector concerned, to implement all measures necessary to improve the functioning of markets' competition”. Since its creation in March 2009
