The Cypriot Competition Authority concludes that the termination of a franchise agreement in a reasonable delay does not constitute an abuse of economic dependence (Bacenco / Orchestra-Premaman)

The case arises out of a complaint filed by Bacenco Ltd against Orchestra-Premaman for the alleged infringement of the Protection of Competition Law 13(I)/2008 (“Law”); concerning the termination of the sub-franchise agreement between Bacenco Ltd and Orchestra-Premaman. Bacenco was an Orchestra-Premaman label shop that provided the sale of clothes and accessories for mothers, babies and children at “MY MALL”, a shopping centre in Limassol. Bacenco functioned as a sub-franchise and was based on an oral agreement made via Virginia Letkaouskaite Koutroupi, the Master Franchiser of the Orchestra-Premaman label products in Cyprus.
