Following the Opinion S2138 of January, 30, 2015 (not yet published), the ICA is going to challenge in Court the Italian Civil Aviation Agency (ENAC) method of allocating air traffic rights from Italy to Israel due to hamper of competition and favor of the dominant player [1]. The outcome may change the whole regulatory framework and open sky competition in routes from Italy to extra EU countries. Moreover, the ICA is signaling its determination to use its enforcement power to challenge general administrative measures that distort competition and raise barriers to entry in key markets thanks to Art. 21bis of law 287/90).
