The Italian Supreme Administrative Court upholds the annulment of a non-compliance decision of the Competition Authority due to breaches of the rights of the defense (Italian National Bar Council)

The Italian Supreme Administrative Court (“Consiglio di Stato” or “CdS”) upheld the annulment of a decision adopted by the Italian Antitrust Authority (“IAA” or “Authority”) with reference to the alleged non-compliance of the Italian National Bar Council (Consiglio Nazionale Forense, “CNF” or “Council”) with a previous decision concerning anticompetitive conducts aimed at setting minimum tariffs for professional legal services as well as at banning online advertising for legal services. The IAA decision against CNF On July 16, 2013, the IAA initiated proceedings to ascertain the anticompetitive conducts allegedly carried out by the CNF, consisting in the adoption and publication of two resolutions aimed at limiting the autonomy of lawyers with reference to their economic behavior on the market
