The Latvian Competition Council fines a dominant liquified gas provider for excessive pricing (Propana Gaze)

1. Summary of the case On 10 December 2008 the Latvian Competition Council passed the decision n° E02-123 finding that Latvijas propana gaze SIA (“LPG”) has abused its dominant position in the relevant market for supply of liquefied gas to apartment houses from underground and above-ground group equipment in the territory of Latvia. The abuse was constituted by charging unfairly high gas tariffs (breach of Section 13(1)(4) of the Competition Law). LPG was imposed a fine of LVL 93'571,71. 2. Facts and decision The proceedings were instituted on the basis of a complaint filed by INTERGAZ SIA. As a result, the Competition Council assessed the fairness of the gas tariffs charged by LPG in 2006, 2007, and January-October 2008.
