On 3 February 2021, the Department for Business, Energy & Industry Strategy ("BEIS") published a consultation paper outlining proposals for a new subsidy control regime in the UK ("Consultation Paper"). The need for a new subsidy control regime has been prompted primarily by: the State Aid (Revocations and Amendments) (EU Exit) Regulations 2020, which had the effect of ensuring that EU State aid law does not form part of UK domestic law after the end of the transition period; and provisions of the UK-EU Trade and Cooperation Agreement ("TCA") requiring the UK to develop and maintain an effective system of subsidy control.
