On 28 October 2020, the Court of Justice (“ECJ”) answered a reference for a preliminary ruling from the Consiglio di Stato (Council of State, Italy) concerning the interpretation of Articles 3 and 6 of Regulation (EU) No 1407/2013 of 18 December 2013 on the application of Articles 107 and 108 TFEU to de minimis aid (the “de minimis Regulation”). The background of the case is a dispute between the Italian company Zennaro and the Italian National Institute for Insurance against Accidents at Work (“INAIL”).
