The Portuguese Competition Authority adopts a new decision concerning a cartel of pharmaceutical companies following a decision of the Lisbon Commercial Court (Abbot, Bayer, Johnson & Johnson, Menarini)

On 17 January 2008 the Portuguese Competition Authority (hereinafter ‘CA') has approved a new decision concerning two previous cases, which have now been appended, and referring to two cartels on the pharmaceutical sector involving the companies Abbott, Bayer, Menarini and Johnson & Johnson. This decision follows a Court decision, on April 2007, which essentially upheld a previous CA decision of 2005 [1], regarding the aforementioned pharmaceutical cartels, since the Lisbon Commercial Court merely determined that certain procedural acts on the part of the CA had to be repeated. Accordingly, the Court sent the case back to the CA.
