The Italian Competition Authority opens proceedings against pharma-companies in the wholesale distribution market of drugs (“Distribuzione di farmaci senza obbligo di ricetta alle parafarmacie”)

On 27 September 2006 the “Autorità Garante della Concorrenza e del Mercato” (hereinafter “AGCM”) opened proceedings against different companies in the wholesale distribution market of drugs, for alleged breach of Article 2 of Law n° 287/90, the national provision similar to Article 81 EC. On one hand, the complainants were the “Movimento Nazionale Liberi Farmacisti” (the national political movement of chemists, hereinafter “MNLF”), the “Federconsumatori Basilicata” (the no-profit association for the information and protection of the consumers, operating in the district of Basilicata, hereinafter “Federconsumatori”) and the owners of two different “parafarmacie” (business enterprises that differ from the pharmacies due to the type of drugs they may only sell to the consumers, namely medicines with no
