The French Parliament gives new injonctive powers to the Competition Authority

France: New Law on economic Regulation in overseas Departments vests the Autorité de la concurrence with specific Injunctive Powers* On 21 November 2012, the law relating to economic regulation in France’s overseas departments was published in the French Official Journal. It aims at addressing the structural basis of the cost of living in France’s overseas departments, where retail prices are between 30% and 50% higher than in mainland France. These structural handicaps such as insularity, high barriers to entry, oligopolies, and a lack of commercial integration within the direct regional environment, are not sufficient to explain such a large difference in prices alone.
