While the rules on price discrimination lack clarity, the French competition Authority has missed the opportunity to do its part. In order to compensate for the price increase of its products, the Lego France company created a discount scheme for the benefit of its resellers. The discount rates were determined by ratings, corresponding to the fulfillment of various conditions. While this practice did not in itself hinder free competition, certain conditions appeared to be discriminatory.
