The Polish Competition Authority condemns a resale price maintenance agreement and rejects a demand for a commitment decision (Koral and Zabka Polska)

The present decision n° RKT-107/2008 of 31 December 2008 relates to some provisions of the cooperation agreement signed by one of the biggest ice-cream manufacturers in Poland, i.e., Przedsiêbiorstwo Produkcji Lodów “KORAL” - Józef Koral spólka jawna (hereafter: KORAL) and a chain of convenience stores, i.e., Zabka Polska SA (herafter: Zabka) on 18 April 2006. By virtue of this agreement Zabka undertook not to sell KORAL ice-creams at prices lower that the one recommended by the manufacturer. Annex n° 1 to the agreement fixed the recommended prices for the season 2006, while Annex n° 4 provided for Zabka's retail prices that were not lesser than the first ones.
