The Croatian Competition Authority rules on the compatibility of the promotion campaigns of an automobile importer with the block exemption regulation (Sanabilis/Citroën)

Citroën Hrvatska d.o.o. (Citroën) [1] is the exclusive importer of Citroën automobiles in Croatia, which established a selective distribution network of 19 distributors and 22 retailers of original spare parts and repair service centers. One of the Citroën's distributors Sanabilis d.o.o. (Sanabilis) applied to the Croatian Competition Authority (Agencija za zastitu trzisnog natjecanja) (AZTN) with the request to assess Citroën's distribution agreements and conditions it was applying to its promotion campaigns. Sanabilis invoked several issues, which might have negative effect on competition : 1) Citroën requires its distributors to provide a bank guarantee for all supply transactions; 2) The distribution agreement prohibited the distributors from selling the cars to individuals and
