This case note analyses the Turkish Competition Board’s (“Board”) Aygaz decision dated 16.11.2016 with No. 16-39/659-294. The Board assessed allegations that Aygaz and its wholly-owned subsidiary, Mogaz A.Ş. (“Mogaz”), had engaged in resale price maintenance (“RPM”). Background The Board initiated a preliminary investigation in 2013 (“Preliminary Investigation”) in order to assess the allegations that Aygaz engaged in RPM by intervening in the pricing policies of its dealers. In its reasoned decision on 13.03.2013 with No. 13-14/204-105, the Board came to the conclusion that there was no need to initiate a full-fledged investigation given that the practices in question had no object of restricting competition on the market and their anti-competitive effects on the market were very limited.
