The Vilnius District Administrative Court upholds the NCA’s decision in the first Art. 81 EC case in Lithuania (Paper Wholesalers)

On 7 June 2007 the Vilnius District Administrative Court (the “VDAC” or the “Court”) substantially upheld the 26 October 2006 Competition Council's infringement decision in Paper Wholesalers. As reviewed previously in this newsletter, by that decision the Competition Council found five wholesalers of paper in breach of Article 81 EC and its national equivalent (Article 5 of the Law on Competition) for running the market shares data exchange scheme. The appeals were brought by two out five wholesalers - UAB Libra Vitalis and UAB Schneidersöhne Baltija - the latter managing to receive a fine reduction by more than 20 percent. In its original decision, the Competition Council found the relevant national wholesale markets of chalky paper and office paper populated by a small number of players
