The Hungarian Competition Office establishes that the provisions on the advertising of legal services of the lawyers code of ethics restrict competition under Art. 81.1 EC (Hungarian Bar Association)

Summary of Facts Proceedings were initiated ex officio by the Hungarian Competition Office (HCO) against the Hungarian Bar Association (Bar) in order to determine whether the following provisions of the Code of Ethics (Code) and the official position of its presidency (Position) qualify as decisions restricting competition under Article 11(1) of the Hungarian Competition Act that is the equivalent of Article 81 (1) EC. The Code prohibits inter alia the attorney from : using an agent to recommend his/her services ; promising more favorable/better/faster handling of certain cases before certain authorities ; advertising with more favorable fees as compared to other attorneys ; publishing the change of his/her official data (seat, telephone, fax number, etc.) for more than two
