The Slovenian Administrative Court upholds the Competition Authority’s decision in a bus bid rigging case and sets the standards for the analysis of future by object restrictions (Bus operators)

On 16 September 2021, the Administrative Court of the Republic of Slovenia (“Administrative Court”) issued a judgment in an administrative dispute against a decision of the Slovenian Competition Protection Agency (“CPA”) deciding on an infringement of the Article 6 of the Slovenian Act on the Prevention of the Restriction of Competition Act and Article 101 of the Treaty on the Functioning of the European Union ("TFEU"). In the case at hand, the Administrative Court found that the agreement in question constituted a restrictive agreement which restricts competition by object.
