The EU Commissioner Margrethe Vestager announces changes to the EU merger control scheme

Abstract: Last 11 September 2020, Ms. Margrethe Vestager, European Commissioner for Competition, released a new doctrine for the implementation of Article 22 of the EU Concentration Regulation. This provision empowers EU Member States to refer a merger to the European Commission for the latter to review and when necessary, prohibit it. This new doctrine will apply from mid-2021 and results in returning to the first doctrine of application of the provision. This change of doctrine is an original solution aiming at enabling the European Commission to review “killer acquisitions” escaping EU and Member States’ merger control schemes.
