Pursuant to Article 16(4) of the Law no. 287/1990, the Italian Competition Authority (ICA) has decided to open a Second Phase investigation into a merger between two undertakings operating in the optical field where they manufacture, amongst other things, sunglasses and lenses for sunglasses [1]. The ICA took the position that the planned merger might be conducive to horizontal and vertical negative effects on competition. The notified merger Luxottica Group Spa (Luxottica) produces and markets frames for eyeglasses, sunglasses and ophthalmic and non-ophthalmic lenses. Barberini Spa (Barberini) produces and markets plano UV-coated lenses and, through its subsidiary Barberini GmbH (BG), also produces and markets plano lenses. Barberini is also a minor producer of ophthalmic lenses
