The Lithuanian Competition Authority fines a retailer for using unfair practices against distributors (Rimi Lietuva)

On 18 September 2015 the Competition Council fined UAB RIMI LIETUVA (hereinafter: RIMI) for an infringement of Article 3(1) point 8 of the Law of the Republic of Lithuania on the Prohibition of Unfair Practices of Retailers. During the investigation the Competition Council analyzed whether the clauses of the retail contracts, which RIMI concluded with the distributors of drinks and foodstuffs, with regard to the promotion of the sales of goods and the management of the costs related thereto did not infringe Article 3 of the Law on the Prohibition of Unfair Practices of Retailers. Article 3(1) point 8 of the aforementioned Law prohibits the retailers with significant market power to require from the distributors directly or indirectly to bear part of the costs related to the promotion
