The Greek Supreme Court clarifies its interpretation of the ’association of undertakings’ notion in the application of article 101 TFEU (Greek Dental Bar Associations)

By virtue of judgments 148/2015, 149/2015 and 150/2015, the Greek Supreme Court held that the Greek Dental Bar Associations are “associations of undertakings” and their decisions on the imposition of minimum thresholds of fees infringe upon article 1 of Greek Law 703/1977 (now Law 3959/2011). Brief History In the context of an ex officio investigation of an alleged infringement of article 1 para. 1 of Law 703/77 (now 3959/2011) by the Hellenic Dentists’ Federation (HDF) and the Dentists’ Associations of Attica, Piraeus, Achaia, Heraklion, Serres, Magnesia and Thessalonica, the Hellenic Competition Commission (HCC) found that (decision 292/IV/12.9.2005) the audited Dental Associations constitute associations of undertakings within the meaning of Article 1 of Law 703/1977, as in force,
