The Spanish Competition Authority fines lift manufacturers close to €5 million for unfair competition (ASCENSORES-2)

On 17 September 2013, the Spanish Competition Commission (“CNC”) imposed a fine of €4,867,317 on four lift manufacturers for unfair trading practices. The CNC initiated its investigation following two different complaints, one by a property owners’ association and one, seven months later, by CITYLIFT S.A., a competitor active in the lift maintenance and repair sector but not in the lift manufacturing sector, claiming that five lift manufacturers, namely ZARDOYA OTIS S.A. (“OTIS”), SCHINDLER S.A. (“SCHINDLER”), ASCENSORES ENINTER S.L. (“ENINTER”), ASCENSORES IMEM S.L. (“IMEM”) and INDUSTRIAL DE ELEVACIÓN S.A. (“INELSA”), had incurred in a series of anticompetitive practices. Considering that there were rational indicia to suspect a potential infringement of Article 3 of the Spanish Competition Act
