The Moldovan Competition Authority investigates the pricing of SMS/MMS services on the telecommunications market (Orange Moldova)

On 12 July 2011 the Moldovan Competition Authority (CC) [1] received a complaint lodged by the telecom operator IM Moldcell SA alleging the existence of an abuse of dominant position on the mobile telecommunications market committed by IS Orange-Moldova SA. The applicant submitted that Orange-Moldova launched a promotional campaign offering its current subscribers to send SMS and MMS messages at a promotional price of MDL 0,1 to any number during the weekend days of July 2011. Moldcell qualified this promotional campaign as application of predatory prices and, while Orange-Moldova enjoyed dominant position (with 60-70% market share based on turnover or number of subscribers) on the relevant market, as an abuse of dominant position. The 2012 Competition Act [2] provides that
