The Spanish National Court annuls a fining decision in a gun-jumping case (Bergé)

The Spanish National Court (Audiencia Nacional, "AN") adopted a judgment on 28 September 2012 annulling the Decision of the Spanish National Competition Commission (Comisión Nacional de la Competencia, "CNC") of 29 July 2010 that imposed a € 76,000 fine on Bergé. The infringement committed by Bergé consisted in the implementation of a concentration prior to its notification. The CNC Decision indicates that Bergé acquired on 18 February 2008 control over Marítima Candina.
