The Macedonian Supreme Court upholds the Competition Authority’s decision finding an abuse of dominance on the electricity distribution market (Elektrostopanstvo)

On 6 September 2010 the Macedonian Supreme Court upheld the infringement decision of the Macedonian Competition Authority (KZK) [1] issued against the electricity company EVN Macedonia (EVN) [2] for committing an abuse of dominant position on the market for electricity distribution. The case dates back to 21 March 2008 when the KZK issued its first decision [3] against EVN. According to the KZK, EVN has abused its dominant position by imposing on its customers a monthly fee of MKD 6 (approx. EUR 0,09) for the issuance of the invoice containing information about the consumed electricity and the payment due for consumption. The KZK characterized this act as
