The EU General Court reduces fine in Spanish raw tobacco case (Deltafina)

On 8 September 2010, the General Court handed down its judgment on an appeal brought by Deltafina against the European Commission’s decision of 20 October 2004, fining it € 11,880,000 for its participation in a cartel of producers and processors of raw tobacco in Spain. The General Court upheld the Commission’s decision, but reduced Deltafina‘s fine to € 6,120,000, finding that, contrary to the Commission’s findings, Deltafina had not acted as the instigator or leader of the cartel.
