The Czech supreme administrative Court confirms regional Court’s cancellation of NCA’s decision concerning participation in alleged price fixing concerted practices (Bakery Cartel)

On 30 September 2008, the Czech Supreme Administrative Court rejected the cassation appeal lodged by the Office for Protection of Competition (“Office”) against the judgment of Regional Court in Brno that cancelled Office's concerning participation in alleged price fixing concerted practices on markets of fresh bread and pastry products and of sweet pastry products by Delta Pekarny, Odkolek and Penam (three main bakery companies active on the Czech market). Despite the Supreme Administrative Court disagreed with certain aspects of notion of concerted practices as it was employed by the Regional Court in Brno, it concurred with the Regional Court as to the outcome, i.e. that the identification of the alleged cartel in the challenged Office's decision was confusing and to a certain
