The Spanish Competition Authority fines a company for an abuse of dominance in the cemetery services market (Cementerios de Leganés)

Background In December 1996, Servicios Funerarios Funemadrid, S.A. (“FUNEMADRID”) was granted with the concession to build and exploit the public municipal cemetery of Leganés, a city located in the Region of Madrid, for a 49-year period. The concession contract established that FUNEMADRID would (i) run and exploit the cemetery on an exclusive basis, (ii) be required to develop a regulation on cemetery services, and (iii) be obliged to accept the entry of third party providers complying with the relevant requirements set forth in the regulation on cemetery services. However, no regulation on cemetery services was ever adopted. Between 1996 and 2014, FUNEMADRID allowed marble companies belonging to sectoral association of marble and stone companies “ASEMPIMA” to provide engraving
