The Turkish Competition Board imposes administrative monetary fine on an expo centre operator for abuse of dominance through refusal to deal (Congresium)

This case note analyses the Turkish Competition Board’s (“Board”) Congresium ATO decision dated 27.10.2016 and numbered 16-35/604-269. The Board’s decision comes following the judgment of the Ankara 3rd Administrative Court which annulled the Board’s previous decision with respect to the same case in 2013 by which the Board had decided not to open an investigation. The Board thus launched a full-fledged investigation in order to re-evaluate the complaint made by A ve A Fuarcılık Organizasyon ve Ticaret Ltd. Şti. (“A&A”), a fair and exhibition organiser, who alleged that Ankara Uluslararası Kongre ve Fuar İşletmeciliği Merkezi A.Ş. (“Congresium”), an operator detaining an exclusive agreement regarding the organization of events on Ankara Chamber of Commerce’s (“ATO”) exposition and convention
