The Polish Competition Authority clears an acquisition in the small package delivery sector (DPD / seven)

In its decision of 1 October 2014, the Polish competition authority (Urząd Ochrony Konkurencji i Konsumentów, the "UOKiK") unconditionally cleared DPD’s 100% acquisition of shares in a fellow small package delivery company, Siódemka (in English: “seven”). This decision is one of a limited number of reasoned clearance decisions issued by the UOKiK last year which does not typically publish such decisions unless the parties’ combined market share is above 20% in the horizontally affected markets or 30% in the vertically affected markets (irrespective of whether there is an actual supplier–recipient relationship between the parties) or, in the case of a conglomerate merger, a party to the concentration holds a market share of more than 40% in the market where there are no horizontal or vertical
