A French Court orders immediate stay of proceedings in a follow-on action based on the animal feed phosphates cartel (FRSEA Bretagne)

Introduction On 20 July 2010, the European Commission (“the Commission”) adopted a decision regarding the application of Article 101 of the Treaty on the functioning of the European Union (“TFEU”) in relation to anticompetitive practices perpetrated on the European market for animal feed phosphates [1]. In this case, two of the defendants (“the Defendants”), while having benefited from the leniency procedure, did not admit full liability [2] in respect of infringement under the Commission’s settlement procedure. On 1 October 2010, they lodged an appeal before the General Court against the Commission’s decision seeking its annulment. The appeal is still pending [3]. In parallel, a follow-on damage claim has been brought against the Defendants by the Regional Federation of the farmers’
