The Romanian Competition Council fines a professional association for setting execution expenses and for limiting access to the market (Union of bailiffs)

On 7 November 2012, the Romanian Competition Council (the “Council”) published its decision number 58 /2012 for the sanctioning of the Romanian National Union of Bailiffs (the “Union”). The professional association was fined for infringing competition rules by (i) setting enforcement expenses that exceeded the legal framework, (ii) creating barriers to entry the market through excessive entrance fees applied in a discriminatory manner and by (iiii) establishing a discriminatory regime for professional training programs, potentially leading to arbitrary exit from the market. The Competition Council found that Union’s decisions taken in this respect constituted a cartel caught under both article 5(1) of the Competition Law no. 21/1996 (the “Competition Law”) and article 101 (1) of the Treaty
