The Romanian Competition Authority sanctions a professional association for illegal decisions adopted by what it considers to be an association of undertakings (National Union of Bailiffs)

Introduction The Romanian Competition Council ("RCC") released at the end of 2012 a decision ("RCC Decision") pursuant to an investigation concerning the Romanian National Union of Bailiffs ("Union"), i.e. legal professionals charged with the execution of judicial decisions, which allegedly adopted certain decisions with anticompetitive implications in the period 2007 - 2012 ("RCC Investigation"). This is the first time an RCC investigation is focused on potentially anticompetitive practices involving an association of independent legal professionals which acts as a body in which membership is mandatory in order for persons to be able to exercise a certain profession. The RCC Investigation had as object the breach of art. 5 of Competition Law (which mirrors the provisions of art.
