The Slovak Republic amends the Competition Act as regards merger control

On 19 October 2011, important amendments to the Slovak Competition Act [1] (“Amendments”) modifying and simplifying the merger control rules were passed. The Amendments shall become effective as of 1 January 2011. Turnover Thresholds The existing turnover threshold test has been amended to reflect more thoroughly the criterion of the local nexus, i.e. turnovers achieved in the Slovak Republic. According to the Amendments, concentrations with the following turnovers (achieved in the last closed business year) shall be notified to the Antimonopoly Office of the Slovak Republic (“Office”): – a. Combined Slovak turnover of all parties is at least EUR 46 million and individual Slovak turnover of each of at least two parties reaches or exceeds EUR 14 million; or – b. The individual Slovak
