The Competition Authority of Bosnia & Herzegovina closes the investigation into the alleged abusive practices of the incumbent telecom operator without reaching a decision on the merits (Telekom RS / Crumb group)

On 12 October 2011 the Competition Authority of Bosnia & Herzegovina (KV) [1] closed its investigation into the alleged abuse of dominant position on the part of the incumbent telecom operator Telekom RS. The KV‘s investigation was prompted by a complaint lodged by an independent telecom operator Crumb group d.o.o. who claimed that Telekom RS abused its dominant position by obstructing access to its land line network and applying discriminatory access policies towards the independent providers. Telekom RS was an incumbent public telecom operator, which along with BH Telecom and Hrvatske telekomunikacije d.d. was designated as the undertaking with the significant market power (SMP) by the sector regulator – the Communications Regulatory Agency (RAK) [2].
