A Spanish Court provides for the first time ever for compensation of damages caused by a cartel (Sugar Cartel)

The judgment of the Valladolid Provincial Court of October, 9, 2009, is the first case in Spain in which a court provides for a redress of the victims of a horizontal restraint of competition, namely a cartel. It is well-known that cartels are prohibited by article 101 of the Treaty of Functioning of the European Union and, in Spain, by article 1 of the Spanish Competition Act 15/2007.
