The Italian Civil Tribunal in Milan holds a decision on the private enforcement of Art. 82 EC concerning the cease of purchase of advertising spaces on leading commercial networks (Sky / Mediaset)

On September 16, 2009 Sky Italia S.r.l. has filed a lawsuit under the Art. 700 of the Italian Code of Civil Procedure with the Tribunal of Milan against RTI and Publitalia , both owned by the Mediaset Group, for the infringement of (a) the antitrust principles under Art. 82 [1] of the European Treaty and (b) the unfair competition according to the Art. 2598, n. 3, of the Italian Civil Code.
