Two investigations conducted by the Italian Competition Authority (ICA) against the incumbent rail operator, the Ferrovie dello Stato group (FS), over alleged infringements of Article 82 EC [1] have been closed by a commitment and an acquittal decision [2]. The ICA started the investigations against FS and its subsidiary, Rete Ferroviaria Italiana (RFI), the manager of rail network, upon receipt of a complaint filed by Nuovo Trasporto Viaggiatori (NTV) [3]. NTV is a new rail operator that plans to launch in 2011 high speed passenger transport services competing with Trenitalia, the train operator controlled by FS.
