On October 22nd, 2009, the Italian Competition Authority (hereinafter: AGCM) [1] handed down two distinct rulings which concluded the investigatory proceedings concerning FS (Ferrovie dello Stato) and RFI (Italian Railway Network) [2]. The two companies were allegedly engaged in abusive excluding conduct by impeding their direct competitors' access to railway maintenance infrastructures in the area close to Naples. The access to such railway infrastructures were deemed necessary to provide a competitive service on the high-speed trait.
